This is the privacy statement Quicksilver Media B.V. (hereinafter also: “Quicksilver”, “we” or “us”) in connection with the website: viveh.com (hereinafter: “website”)

The website offers exclusive clothing products to consumers. As a consumer you have the option, among other things, to place orders via the website, either as a 'guest' or with a registered account. Quicksilver is responsible for the management of the website, as well as for processing the (personal) data provided and processed via and/or on the website.

This privacy statement applies when you visit our website, contact us via that website or place orders via that website. Quicksilver values your privacy and processes your personal data (i.e. information relating to an identified or identifiable natural person) within the meaning of the General Data Protection Regulation 2016/679 (“GDPR”) and relevant national legislation.

In this privacy statement we will explain, among other things, which types of personal data we collect, for which purposes and on what legal grounds. We will explain this in connection with the different ways in which we obtained the personal data.

  • Types of personal data and processing purposes

When you visit our website, place orders or contact us, Quicksilver will process your personal data. This will be explained in more detail here below.

Website visits

When you visit our website, your IP address, traffic data, internet browser type and hardware type will be stored. We also process data relating to website visits, such as the website you came from and your search- and viewing behaviour on our website. This data is used (on an aggregated level) for statistical purposes and to test and improve the user-friendliness of our website. In this regard we also make use of Google Analytics.

In order to present ourselves online with a properly functioning website, Quicksilver has a legitimate interest to process the personal data (on an aggregated level) when visiting the website. We have considered that the importance of a properly functioning website outweighs the very limited infringement caused by the processing of the above-mentioned data.

With your permission, it is also possible to improve the overall website and user experience, e.g. through personalized communication with information, offers and/or promotions tailored to your preferences, interests and (previous) purchases. To determine your preferences and interests, we use information obtained with cookies or similar techniques.

Order placement

You may place an order via the website as a 'guest' or via a registered account. When placing an order as a 'guest', Quicksilver processes the following personal data:

  • Name and address details;
  • Contact details such as (mobile) telephone number and email address;
  • Financial information, such as a bank account number or credit card information.

The processing of the above mentioned data is necessary to follow up the order and to deliver the ordered products to the specified address.

When you create an account via the website, you will be able to order more quickly in the future and view and review your purchase history. Also with a registered account, Quicksilver processes the aforementioned personal data. In addition, the following personal data may be added:

  • Date of birth;
  • Clothing sizes;
  • Other (clothing) preferences.

The processing of this additional data is completely voluntary and is based on consent.

Newsletter

When you have registered for receiving the newsletter, or you have placed one or more orders via the website, we may occasionally keep you informed about new collections, promotions and/or relevant developments in that regard. It is possible to unsubscribe from newsletters at any time via a link in the relevant email.

  • Minors

If you are under the age of 16, the consent of your parents or legal guardian is required to make use of our website and/or make purchases through the website.

  • Personal data we share with third parties

We will never sell your personal data to third parties. In principle, your personal data will not be shared with third parties, unless in the following circumstances:

(i) where we engage external suppliers/companies for the benefit of our product- or service performance ("processors"), for example, payment service providers and IT-providers. With these data processors we have entered into data processing agreements with regard to the careful handling and security of personal data;

(ii) where we work together with external partners/companies for the benefit of the product and/or service performance, such as delivery services in order to deliver purchase orders. These service providers are data controllers and independently responsible for the processing of your personal data;

(iii) other 'influencer' web shops related to Quicksilver that offer apparel / clothing and may be of interest to you based on the preferences and/or interests as specified by you;

(iv) (government) authorities or organizations to whom we must disclose certain personal data on the basis of a legal obligation.

In principle, your personal data will not be transferred to parties or countries outside the European Economic Area (EEA). To the extent personal data will be transferred to countries or third parties outside the EEA, we will take into account the statutory requirements in relation thereto.

(v) Our website uses Klaviyo, a third party that handles the e-mail traffic from our website and the sending of any newsletters. Some confirmation emails you receive from our website and web forms are sent through Klaviyo's servers. Klaviyo will never use your name and e-mail address for its own purposes. At the bottom of every e-mail that is automatically sent via our website you will see the 'unsubscribe' link. If you click on this you will no longer receive e-mail from our website. This can seriously reduce the functionality of our website! Your personal data is stored securely by Klaviyo. Klaviyo uses cookies and other internet technologies that provide insight into whether e-mails are opened and read. Klaviyo reserves the right to use your data to further improve the service and to share information with third parties in this context.


(vi) We use the services of Sufio to keep track of our administration and accounting. We share your name, address and residence details and details regarding your order. This data is used for the administration of sales invoices. Your personal data is sent and stored protected. Sufio is bound to secrecy and will treat your data confidentially. Sufio does not use your personal data for purposes other than those described above.

(vii) We collect reviews via the WebwinkelKeur platform. If you leave a review via WebwinkelKeur, you are obliged to provide your name, place of residence and e-mail address. WebwinkelKeur shares this information with us, so that we can link the review to your order. WebwinkelKeur also publishes your name and place of residence on its own website. In some cases WebwinkelKeur may contact you to explain your review. In the event that we invite you to leave a review, we will share your name and email address with WebwinkelKeur. They only use this information for the purpose of inviting you to leave a review. WebwinkelKeur has taken appropriate technical and organizational measures to protect your personal data. WebwinkelKeur reserves the right to engage third parties for the provision of the service, for which we have given permission to WebwinkelKeur. All the above-mentioned guarantees with regard to the protection of your personal data also apply to the parts of the service for which WebwinkelKeur engages third parties.

  • Protection and retention of personal data

Quicksilver has taken adequate technical and organisational measures to protect your personal data against loss and the unauthorised access or misuse thereof. Among other things, we make use of a firewall and encryption measures to prevent unauthorized third parties from accessing the data. The data is further stored in locations which are both physically and technically secured. Our systems also log who has had access to the user data, whereby only a limited group of employees has access based on his or her job profile. These employees are also subject to confidentiality obligations.

Quicksilver retains your personal data no longer than is necessary for the purpose for which we have collected the personal data, or in correspondence with an applicable statutory retention term.

You may at all times request the removal of your personal data. We will respond to such request within the statutory timeframe. It may be possible that Quicksilver needs to (temporarily) retain certain personal data for a longer period, regardless of a removal request, for example if this is necessary for the processing of orders or if there is a legal obligation to retain that data.

  • Your rights

You have the right to request access to or the amendment, deletion or data transfer of your personal data. If you have a personal account for the website, you may also update or delete your data within that account yourself. You may furthermore submit a request to restrict or object to certain data processing. You also have the right to withdraw any previously provided consent, without affecting the lawfulness of processing based on consent before such withdrawal.

You may direct any requests or complaints regarding the processing of your personal data to us via the contact details as provided in this privacy statement. We will respond to such requests within the applicable statutory timeframes. For completeness, we also note that you have the right to submit a complaint with the relevant data protection authority (for the Netherlands this is the “Autoriteit Persoonsgegevens”).

  • Cookies

On the website we make use of "cookies" in order to let the website function properly and for statistical purposes. Cookies are small text files that are stored on your computer, for example to remember settings, preferences or surfing behaviour. Cookies can be deleted at any time via the settings of the web browser.

  • Third party websites

The website may contain hyperlinks to third party websites. Quicksilver has no control over such third party websites. It is therefore possible that a different privacy statement applies to the use of these third party websites. This privacy statement only applies to personal data obtained by Quicksilver. We do not accept any responsibility or liability for the operation and/or content of the third party websites, nor for their processing of personal data.

  • Changes

We reserve the right to unilaterally amend this privacy statement to ensure compliance with applicable law and regulations. It is recommended that you consult this privacy statement on a regular basis in order to be aware of any potential changes.

The privacy statement has been prepared in the Dutch and English language. In case of conflict between the Dutch and English version, the Dutch version shall take precedence.
